Woman mistakenly transferred money to a wrong account — to get it back, she had to go to court
In April, a resident of Novopolotsk mistakenly transferred 350 rubles from her account to another bank's client's card. When she realized this, she contacted her bank with an application for the return of the funds, Minsk-News writes .
Bank employees, in turn, sent a message to their colleagues at the other bank with a request to inform the recipient of the money about the situation and offer them to voluntarily return the amount.
The bank's message was sent to the address specified by the recipient when concluding the bank service agreement. However, as it turned out later, the citizen who received the money lived elsewhere and had not informed the bank about the change of address, so the correspondence with the offer for a voluntary return of the sum was returned as unclaimed.
Four months later, the resident of Novopolotsk applied to the Moskovsky District Court of Minsk with a claim against the bank that received the mistaken money transfer. In her statement, along with the demand for the recovery of the sum, she asked to identify the person who illegally received her money and to replace the defendant from the bank with the actual recipient of the funds.
The court identified the recipient and replaced the defendant from the bank with the citizen who received the money. She admitted the claims. The woman believed that 350 rubles had been transferred to her by someone she knew. At the same time, since the dispute arose due to the plaintiff's error, the defendant did not agree to have the court costs of the case imposed on her.
The court ruled to satisfy the plaintiff's claims and recover 350 rubles from the defendant. The court also ordered the defendant to pay the plaintiff court costs for the duty — 84 rubles, as well as legal assistance expenses of 100 rubles.
